This Privacy Notice explains how information about you is collected, used and disclosed by ESB when
you enter into an Open Donor Contract as part of the Donor Program.
We may amend this Privacy Notice from time to time. If we make changes, we will notify you by revising
the date at the top of the notice and, depending on the specific amendments, we may provide you with
additional notice. We encourage you to review the Privacy Notice whenever you access our website to
stay informed about our information practices.

2. Collection of personal data
We collect information, you provide directly to us, such as your contact information, and information
concerning additional donor items (like a donor profile, a “donor essay” and an audio

3. Use of personal data – Open Donor
We may share information about you as follows or as otherwise described in this Privacy Notice:

• As part of the process of approval of you as a donor and the necessary screening and
preparation of the donor sperm is carried out for the purposes of fertility treatment
and impregnation of women (in this connection the processing, etc. of your sperm
implies a processing of genetic data concerning you).

• Your sperm may be distributed to various countries within the EU/EEA, which implies
further processing of your personal data pursuant to applicable national law,
including regulatory requirements.

• Your sperm may also be distributed and used for research and development

activities in accordance with national law.

• Your name and contact details may be released to a donor child or treating clinic,

including for us to comply with regulatory national requirements.

• Your sperm may be used to perform a DNA match with any children of the donors of

European Sperm Bank

• Your name and contact details may be forwarded to national competent, regulatory
authorities in the relevant countries within the EU/EEA in order to comply with
regulatory requirements, including the supervision of adverse reactions.

4. Deletion of personal data
We will delete your personal data when we no longer need to process them in relation to one or more
of the purposes set out above.
In this connection please note that the greater part of the information must be stored by ESB also after
your termination in the Donor Program in order to comply with regulatory requirements, including for
the potential use of DNA-testing to establish genetic relation to a donor child, and to evaluate donor
children genetic diseases (adverse reactions).
However, the data may be processed and stored for a longer period in anonymised form in order for us
to improve our services or for the purposes of scientific research or statistics.

6. Security
We have implemented security measures to ensure that our internal procedures meet our high security
policy standards. Accordingly, we strive to protect the quality and integrity of your personal data. This
includes encryption of data and use of pseudonymisation, whenever applicable.

7. Your rights
You are at any time entitled to be informed of the personal data about you that we process, but with
certain legislative exceptions. You also have the right to object to the collection and further processing
of your personal data including profiling/automated decision-making. Furthermore, you have the right
to have your personal data rectified, erased or blocked. Moreover, you have the right to receive
information about you that you have provided to us, and the right to have this information transmitted
to another data controller (data portability).

8. Withdrawal of consent
You may, at any time, withdraw your consent and we will no longer process your personal data, unless
